BAC: blood alcohol concentration

Blood Test: A blood test is one type of BAC test, and it is generally more accurate than a breath test. As a result, blood tests are harder for attorneys to contest in court. While breath tests estimate BAC based on the alcohol in a person’s breath, blood tests directly measure the alcohol concentration in the bloodstream, providing a more precise result.

Breathalyzer: A breathalyzer test is another common type of BAC test. Outside of the police station the breathalyzer is an unreliable method for police to assess how much you’ve had to drink. A breathalyzer test is administered much faster than a blood test. However, breathalyzers are often criticized for their inaccurate results.

DWI: Driving While Intoxicated; .08 BAC or higher or other evidence of intoxication.

Aggravated DWI: Aggravated Driving While Intoxicated: .18 BAC or higher.

DWAI: Driving While Ability Impaired (by alcohol); .05 BAC to .07 BAC, or other evidence of impairment.

DWAI Drugs: Driving While Ability Impaired by a single Drug other than alcohol.

Impaired Driver Program (IDP): IDP Participants receive comprehensive education on alcohol and drug behaviors, helping them identify and change dangerous habits. Presentations and guided discussions are used to increase participants’ motivation to modify behaviors to protect what they value most in life. Participants also engage in individual and group activities.

Miranda Rights: Constitutional rights based on the 5th and 6th Amendments. These rights concern your right to an attorney, your right to a grand jury, your right to not be tried twice for the same crime, and your right to not make incriminating statements against yourself.

The purpose of the Miranda warning is to ensure that suspects are aware of their rights and can make informed decisions about whether to speak with police or remain silent.
